H.R. 8141 · House bill · 119th Congress
This bill requires a consumer credit data reseller (a consumer reporting agency that does not maintain a credit database of its own, but assembles and merges a consumer's credit information from other agencies that it provides to a third party) to follow reasonable procedures to ensure the maximum possible accuracy of the credit information it provides.
This Act may be cited as the “Fair Credit Reporting Reseller Accuracy Act”.
Section 607 of the Fair Credit Reporting Act (15 U.S.C. 1681e) is amended by adding at the end the following:
“(f) Transmission of information by resellers.—
(1) In general.— Before a reseller transmits information contained in a consumer report to an end user or another reseller, such reseller shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the information relates.
(2) Limitation of liability.— No reseller may be held liable under this title if such reseller accurately communicates information obtained from another consumer reporting agency to an end user or another reseller.
(3) Reseller defined.— In this subsection the term reseller has the meaning given the term in section 603.”.
